A sex offender is any person who resides, works or attends an institution of higher learning in the Commonwealth and who has been convicted of a sex offense, or who has been adjudicated as a youthful offender or as a delinquent juvenile by reason of a sex offense, or a person released from incarceration or parole or probation supervision or custody with the department of youth services for such a conviction or adjudication, or a person who has been adjudicated a sexually dangerous person or a person released from civil commitment on or after August 1, 1981.

Sex offenders are classified according to the degree of dangerousness they pose to the public and their likelihood to reoffend.  There are 4 levels of classification:

Level 1 Sex Offender: A low risk offender.
Where the Sex Offender Registry Board (SORB) determines that the risk of re-offense by an offender is low and the degree of dangerousness posed to the public by that offender is not such that a public safety interest is served by public availability, the board shall give the offender a level 1 designation.  Information on a level 1 offender will not be available to the public.

Level 2 Sex Offender: A moderate risk offender.
Where the SORB determines that the risk of re-offense is moderate and the degree of dangerousness posed to the public is such that a public safety interest is served by public availability of registration information the board shall give a level 2 designation to the sex offender.

Level 3 Sex Offender: A high risk offender.
Where the SORB determines that the risk of re-offense is high and the degree of dangerousness posed to the public is such that substantial public safety interest is served by active dissemination, it shall give a level 3 designation to the sex offender.

If an offender is classified as a level 3 offender and the SORB concludes that such sex offender should be designated a sexually violent predator the SORB may report to the sentencing court the SORB’s reason for recommending this classification.  The sentencing court may determine by a preponderance of the evidence, whether such sex offender be classified as a sexually violent predator.

Any member of the public who is at least 18 years of age or older may request information on sex offenders in their community.  The information will be provided to any person who is seeking the information for his/her own protection or for the protection of a child under the age of 18 or for the protection of another person whom the requesting person has responsibility, care, or custody.

The public shall have access to the information regarding level 2, level 3, and sexually violent predators.  The public can request this information through the local Police Department and/or through the Sex Offender Registry Board.  Level 3 offender registry information can also be obtained from the SORB website @ www.mass.gov/sorb/   To receive the requested information a signed request form along with presenting proper identification is required.

Information contained in the Sex Offender Registry shall not be used to commit a crime against an offender or to engage in discrimination or harassment of an offender.  Any person who improperly uses Sex Offender Registry information shall be punished by not more than two and one-half years in the house of correction or by a fine of not more that $1,000 or by both such fine and imprisonment.
